TERMS AND CONDITIONS

PLEASE READ THE FOLLOWING BEFORE BOOKING

POTENTIAL CONTRAINDICATIONS

If  any of the following apply to you, kindly let Nurse Jasmine know on the initial consultation. She will discuss with her prescribing doctor to make sure you are safe for treatment.

  • If you have keloids, or are prone to keloid scarring.

  • If you are on Accutane, or have used Accutane in the past 6 months.

  • If you have any skin conditions such as Rosacea, Psoriasis, Eczema, or Seborrheic Dermatitis on or around the treated area or excessive sweating, it may affect the your healing process.

  • A minimum of 2 weeks between all medical injectables treatment is required for the same treatment area.

  • If you are on medications, specifically any blood thinning medications, immunosuppressive medications, steroids or antibiotics.

  • If you are currently undergoing any cancer treatment. You must be off of Chemo/Radiation for 6 months prior.

  • If you have cardiac valve disease or suffer from any heart conditions.

  • If you have epilepsy, diabetes, haemophilia, or other bleeding/clotting disorders.

  • If you have had a previous allergic reaction to latex, antibiotics or bees/wasps.

  • If you are diabetic, please consult your doctor prior to getting treatment, then email a doctor's note to info@subtleartaesthetics.com.au prior to anti-wrinkle injections or dermal filler treatment.

TERMS AND CONDITIONS

Term 1 – General

1.1 –  By signing this agreement, you agree that you have read and understood these terms and conditions and agree to be bound by these terms.

1.2 – We reserve the right to amend, add or delete any or all of the terms and conditions at any time without any prior notice.

1.3 – If for any reason Subtle Art Aesthetics is not capable of running the appointment as planned, whether caused by failure of equipment or information technology, line drop out, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of Subtle Art Aesthetics which corrupt or affect the administration, security, fairness or integrity of Subtle Art Aesthetics, Subtle Art Aesthetics reserves the right in its sole discretion, (subject to any written direction given by relevant regulatory authorities), to cancel, terminate, modify or suspend the appointment subject to notice provided to clients.

1.4 – In the circumstance that the appointment cannot be held, we will reschedule (if we deem it is plausible) the appointment with you via telephone call, text message, email or other form of electronic communication, if we are unable to contact you via the methods provided.

1.5 – If any of these Terms and Conditions is determined to be unlawful, unenforceable or void, only the relevant term or condition, or the part of the term or condition, that is unenforceable will be excluded from these Terms and Conditions.

1.6 – Our failure to exercise any right under these Terms and Conditions does not constitute a waiver of that right or prevent the exercise of any other right.

 

Term 2 – Qualification for the Services

2.1 –  We will not carry out any Cosmetic Injectables Treatments if:

(a) you are under the age of majority (18 in Australia) in the place in which you are engaging and accessing the Services (including each and every jurisdiction in which you will access the Services);

(b) you have not completed the Client Consultation Form; and

(c) you are pregnant and/or breastfeeding.

2.2 – We are not bound to provide, and we will not provide, the Services to you until sub-paragraphs 2.1 (a) – (b) above have been satisfied.

2.3 – You acknowledge and agree that the information provided on the Client Consultation Form accurately describes and reflects your current health to the best of your knowledge.

2.4 – If we determine that the provision of the Services to you may not be suitable given the information you have provided on your Client Consultation Form, we reserve our right to refuse our Services to you.

 

Term 3 – Consent

3.1 –  You understand, agree and consent to the following regarding our Cosmetic Injectables/Medical Grade Skin Treatment:

(a) you will be courteous at all given times during our Services to staff members of Subtle Art Aesthetics;

(b) the treatment is for cosmetic purposes only;

(c) you are aware that latex gloves are used by the treating practitioner;

(d) you have been provided with an aftercare leaflet which outlines what is required after the procedure and you understand that failure to follow the aftercare instructions may result in an unwanted aesthetic outcome and/or potential side effects;

(e) we may use Topical Anaesthetics containing Lidocaine and Epinephrine;

(f) it is your responsibility to advise us prior to any treatment if your situation or medical condition ever changes in the future or if you are feeling unwell on day of treatment as this can directly affect your safety and the result.

(g) you consent to us taking a before and after photo of the Cosmetic Injectables Treatment that is part of the consent process for medical audits. You may give additional consent for your photos to be used on our social media pages. This additional consent can be revoked at any time by emailing: info@subtleartaesthetics.com.au.

 

Term 4 – Non-Provision of the Services

4.1 – We may refuse to provide the Services at any time if, for reasons other than those set out in Term 2, we in our sole discretion decide to do so. If we terminate the Services in these circumstances, the terms of Term 5 & Term 7 below will apply.

 

Term 5 – Refusal of an Order for the Services

5.1 – We, in our sole discretion and without having to provide a reason to you, may refuse any order to provide the Services to you.

 

Term 6 – Price and Payment

6.1 – Our price list for each of our Services is listed on our booking system/social media pages.

6.2 – Acceptance is made of our Services upon payment for the quote provided by Subtle Art Aesthetics.

6.3 – Subtle Art Aesthetics reserves its right to alter the Price of our Services as per condition 1.2 prior to acceptance.

Cosmetic Injectables/Medical Grade Skin Treatment – Initial consultation fee

6.4 – A $50 initial deposit/consultation fee is required (non-refundable).

6.3 – If you decide to proceed, this deposit will be deducted from the total fee for the Cosmetic Injectables/Medical Grade Skin Treatment

6.4 – Upon completion of the Cosmetic Injectables/Medical Grade Skin Treatment, the balance is required to be paid.

6.5 – Payment can be made via Cash or via the EFTPOS machine on the premises. Visa, Mastercard and Afterpay are accepted via the EFTPOS machine.

 

Term 7 – Refunds, Cancellations & Rescheduling

7.1 -If after your initial deposit/consultation, you wish to cancel, your initial deposit/consultation fee is non-refundable.

7.2 – Subtle Art Aesthetics reserves its right, in its sole discretion, to have your initial deposit/consultation refunded. This is on a case to case basis and, in special circumstances, will this be refunded.

7.3 – If you become aware that you are unable to attend your appointment and/or complimentary Session, you must inform us at least 48 hours prior to the appointment or Session. Failure to provide adequate notice (by email, call or text) will result in your deposit/consultation fee being forfeited and/or the loss of your complimentary Session.

 

Rescheduling your Complimentary Session

7.4 – A $50 fee is required to be paid upfront for rebooking your Session should you not inform us 48 hours prior of your appointment.

7.5 – If you attend an appointment 15 minutes late from the designated appointment time, Subtle Art Aesthetics may cancel the appointment and a surcharge to have this rebooked will apply in accordance with condition 7.4.

7.6 – If an appointment and/or complimentary Session needs to be rescheduled by Subtle Art Aesthetics, we will provide you notice as per condition 1.4. In this instance, Subtle Art Aesthetics will provide clients the option for a refund if the time and date is not suitable to your schedule.

7.7 – In the event that you are unable to attend your appointment, Subtle Art Aesthetics will reschedule your appointment at a suitable date and time in accordance with the next available date on our calendar.

 

Term 8 – Liability & Indemnity

8.1 –  Our liability to you is limited to:

(a) in the event that, in providing the Services to you, we breach any of the consumer guarantees set out in the Competition and Consumer Act 2010 (Cth) (“the Act”), and at our sole discretion, the supply of the Services again or the cost of having the Services supplied again; and

(b) in any other circumstance, and to the fullest extent permitted by law, and at our sole discretion, the supply of the Services again or the cost of having the Services supplied again.

 

You acknowledge and agree that, to the fullest extent permitted by law:

(c) we will not be liable for, and you indemnify us against, any consequential loss or damage suffered by you or any other party as a direct or indirect result of us providing the Services to you; and

(d) nothing in these Terms and Conditions has the effect of contracting out of the Act.

 

8.2 – If you breach any of these terms, you indemnify us against all claims, liabilities, expenses (including legal fees on a solicitor-client basis) or losses that may be made against us or suffered by us arising from your breach of these Terms and Conditions.

 

Term 9 – Warranties & Guarantee

9.1 – Whilst every care is taken to ensure that the Services we provide are to the highest possible standards, we make NO guarantee or warranty of the results due to the nature of skin as it heals, and aftercare taken by clients.

9.2 - The practice of cosmetic medicine is not an exact science, and no guarantees can be or have been made concerning the expected results.

9.3 – The Services are provided on an “as is” and “as available” basis with no express or implied warranty or conditions as to merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.
